Legal Services

The City Attorney, appointed by the Mayor with the approval of the Council, is the legal advisor to the Mayor and City Council, City Manager, the City Planning Commission, and all departments of the City government. The City Attorney’s Office manages all outside legal counsel and must be admitted to practice by the Maryland Court of Appeals. City Attorneys attend City Council meetings, City Planning Commission meetings and other meetings as needed, and provide counsel and assistance relative to legal issues which may arise. The Office is also responsible for representing the City in litigation and other legal disputes; reviews or prepares proposed Charter amendments, ordinances, resolutions and other legal documents; and gives legal advice.

This Division oversees the City Elections and supervises the Municipal Clerk.

Whistleblower Information

The City of Gaithersburg upholds the public trust by operating in an open, ethical and law-abiding environment. We have an organizational responsibility to create an environment where suspected improper or illegal actions can be reported without fear of retaliation. The Mayor and Council recently enacted a Whistleblower Ordinance to ensure that we continue to hold ourselves to the highest ethical standard.
