NOTICE OF CONTINUATION OF A PUBLIC HEARING
In accordance with Section 24-187 through 190 of the City of Gaithersburg Zoning Ordinance, the City of Gaithersburg Board of Appeals will conduct a Public Hearing as noted below.

In accordance with Section 24-167A(D)(2) and Section 24-187 of the City of Gaithersburg Zoning Ordinance, the Board of Appeals will conduct a public hearing on the above-referenced application in the Council Chambers at City Hall, 31 South Summit Avenue, on dates noted above at 7:30 p.m. or as soon thereafter as this matter can be heard. The hearing has been continued from the February 10, 2011, April 14, 2011, May 12, 2011, June 9, 2011, July 14, 2011, September 15, 2011, October 13, 2011, November 10, 2011, January 12, 2012 February 9, 2012, February 29, 2012, March 16, 2012, March 20, 2012, and April 12, 2012 Board of Appeals meetings.
The application requests a Special Exception to permit a Telecommunications Facility, utilizing fifteen (15) panel antennas and related ground equipment, installed via a Fort Worth power mount onto PEPCO tower 86S, located near the intersection of Travis View Court and Travis View Avenue, Gaithersburg, Maryland. The property is located in the R-A (Low Density Residential) Zone. The special exception is allowed by §24-25(11) of the City of Gaithersburg Zoning Ordinance (Chapter 24 of the City Code) in compliance with §24-167A(D)(2), subject to the review of the Board of Appeals.
The purpose of the hearing will be to receive the evidentiary matters presented to the Board of Appeals at its hearing of April 12, 2012, which relate to the alternative landscape plans and related site plan documents for the requested special exception, compliance with the Gaithersburg Master Plan, and the number of antennas requested for the special exception. The parties may call witnesses, cross-examine witnesses, and submit documents or other evidence. The hearing will be conducted in accordance with the Rules of Procedure of the Board of Appeals, and a copy of those rules may be obtained here - Board of Appeals Rules of Procedure (pdf file).
The Lakeforest Glen Homeowner’s Association has been designated as the spokesperson for the residents of that community. The failure of a party to appear for this hearing may result in an adverse action against the party.
