Public Comment on Small Cell Facility Rights-of-Way Regulations
Mayor & City Council will hold a public hearing on the proposed amendments on January 7.
Committed to ensuring that the City was prepared for requests for Small Cell Antenna installations, the Mayor & City Council adopted Rights-of-Way (ROW) Regulations in December of 2017. Recently, the Federal Communications Commission (FCC) published a new ruling affecting the City’s right to regulate small cell facilities in the ROW. Additionally, Crown Castle and AT&T have approached the City to reevaluate the adopted regulations.
To address these two events, on December 17, 2018, the Mayor & City Council approved the Introduction of Amendments to Regulations for the Installations in Rights-of-Way Located within the Incorporated City Limits of Gaithersburg as provided by Chapter 2 of the City Code, entitled “Administration.” A copy of the proposed modifications to the Regulations and a summary PowerPoint presentation are available on the Small Cell/Wireless Facilities City Project Page.
The Mayor & City Council will hold a public hearing on the proposed amendments on January 7, 2019, at 7:30 p.m. at City Hall. At that meeting they will also determine when the public record (comment period) will close. Comment can be made at the meeting or in writing up until the closing of the public record.
