The subject property is located in the Kentlands Square Shopping Center, along the private road connecting 195 Kentlands Boulevard (Mattress Firm) and 96 Main Street (Chipotle).

Proposal

The applicant, Saul Holdings Limited Partnership, has submitted a schematic development plan (SDP-7712-2017), requesting approval of three infill commercial buildings totaling 16,000 square feet, and associated minor site changes. This proposal is similar to the previously-approved SDP-03-005 from December 1, 2003, which proposed four infill commercial buildings, one of which (Chipotle / Cold Stone) was constructed.

Status

The joint public hearing on SDP-7712-2017 was held on Monday, October 16, 2017. The Planning Commission’s record closed at 5 p.m. on Wednesday, November 22, 2017. The record for the Mayor and City Council closed at 5 p.m. on Friday, December 15, 2017. During the policy discussion at their January 16, 2018 meeting, the Mayor and City Council voted to re-open their record indefinitely to allow the applicant to submit additional information in response to the Planning Commission’s recommended condition regarding the drive-thru design. At their January 17, 2018 meeting, the Planning Commission voted to re-open their record indefinitely for the same purpose.

In response to the applicant submitting a revised plan showing a re-configured drive-thru (Exhibit #61), the Planning Commission, during its February 21, 2018 meeting, announced the re-closing of its record at 5 p.m. on March 9, 2018. During the rescheduled March 28, 2018 Planning Commission meeting, the Commission recommended approval of SDP-7712-2017. At their March 19, 2018 meeting, the Mayor and City Council announced the closing of their record at 5 p.m. on April 3, 2018, and scheduled their policy discussion for the April 16, 2018 Council meeting.

During the April 16 Policy Discussion, the Council voted to re-open their record indefinitely to allow the applicant to submit additional information regarding the proposed drive-thru. At their April 18, 2018 meeting, the Planning Commission voted to re-open their record indefinitely for the same purpose. Following the applicant’s submission of additional information on May 16, the Planning Commission voted to close its record on May 25, 2018. During the June 6, 2018 Planning Commission meeting, the Commission recommended approval of SDP-7712-2017. At their June 4, 2018 meeting, the Mayor and City Council announced the closing of their record at 5 p.m. on June 22, 2018. During the July 16, 2018 Policy Discussion meeting, the City Council approved SDP-7712-2017 in a 3-1 vote.
